We brought claims for the parents of a deceased child under the Human Rights Act 1998 for violation of his right to life under Article 2 of European Convention of Human Rights.
The Deceased died in his twenties having jumped from a bridge. He had had a longstanding history of self-harm, suicidal ideation, impulsivity, psychosis and bipolar affective disorder. It was alleged that the Defendant was negligent in the discharge of the Deceased without finding him suitable accommodation and providing insufficient support following discharge. But for these failures the Deceased would not have suffered such a severe deterioration in his mental health and would not have ended his life when he did.
Liability was disputed by the Defendant but the claim settled.
