Our client was employed as a healthcare support worker at a hospital and was required to work with a patient known to have a history of drug abuse, aggressive and violent behaviour. Our client was attacked by the patient, who punched him several times and struck his head against a radiator. As a result our client sustained a concussive head injury, a large laceration to his head, various bruises, and post concessional headaches. In addition our client developed psychological problems as a result of the assault.

Whilst liability was admitted at an early stage there was a significant dispute between the parties as to the impact of the injuries on our client’s work capabilities and particularly whether he was capable of returning to his pre-accident occupation. The balance of the medical evidence ultimately indicated that our client should be capable of returning to his pre-accident occupation.

Offers put forward by the third party were still to low, but a subsequent Claimant Part 36 offer did lead to resolution of the claim without the need for a trial.
